(2) In addition, you have the right to submit a complaint to a supervisory body for data protection if you believe that our processing of your personal data is unlawful. (3) Objection to processing of your data

Where we base the processing of your data on the weighing of interests, you can object to the processing. This is the case where the processing in particular is not required in order to fulfil a contract with you. We show this in the corresponding description of the functions. When making such an objection, we ask that you provide reasons why we should not process your personal data as we have done. In the case of substantiated objection, we will examine the situation and cease or adapt the data processing or demonstrate to you our urgent legitimate reasons for continuing processing.

3. Data security

Because the security of your data is important to us, your personal data is transmitted via a secure TLS encryption/connection. TLS (transport layer security) is a protocol for encrypting data transmission on the internet. We use it to protect your personal data from third-party access.  You can see that the connection is encrypted by the prefix “https//:” and/or the padlock symbol.

We also use technical and organisational measures to protect our website and other systems against loss, destruction, access, modification and distribution of your data by unauthorised persons. Despite regular checks, it is not possible to provide full protection against all hazards.

4. Visiting our website

With the mere informational use of our Internet presence, i.e. if you do not register or otherwise send us information, we will only collect the personal data, which your browser sends to our server. As soon as you request a file from our Internet presence, access data will be collected and stored as standard. 

This data set comprises the following:

  • The page from which the file was requested
  • The name of the file
  • The date and time of the request
  • The quantity of data transmitted in each case
  • The access status / HTTP status code (i.e. whether the file was transmitted, not found, etc.) 
  • A description of the type and version of the web browser used
  • The operating system installed and the resolution set
  • The language of the operating system

We need this data in order to display our website and to ensure its stability and security. In addition, it is analysed for internal statistical purposes and for technical administration of the website. The legal basis is Art. 6 Para. 1 Clause 1 lit. f GDPR. Our vital interest results from the purposes of data collection stated.

The access data additionally collected is deleted no later than fourteen days after the process, unless we have been able to find misuse. We then continue to store the access data for prosecution. The legal basis is Art. 6 Para. 1 Clause 1 lit. f GDPR.

5. Use of our online shop

(1) If you wish to place an order in our online shop, you must provide data such as your

•    Name
•    Address
•    Email address

during the order process. The data collected in this context can be seen from the respective input screens, on which mandatory entries are specially marked. All other information is optional. Provision of your personal data serves the purpose and is required to the extent that this is necessary for conclusion of the contract and processing of your order. The legal basis is Art. 6 Para. 1 Clause 1 lit. b GDPR.

(2) You have the option of creating a customer account. In order to use your personal data for further, subsequent orders, we save and process the data you provide, but you may retract your permission at any time. The legal basis is Art. 6 Para. 1 Clause 1 lit. b GDPR.

(3) The provisions of trade and tax law obligate us to save your address, payment and order data for a period of ten years. Your data will therefore not be completely deleted even when storage is no longer required for the concluded contract. However, processing is restricted to the extent that processing is required in order to fulfil the statutory obligations. The legal basis is Art. 6 Para. 1 Clause 1 lit. c GDPR.

(4) We will use the data that you have transmitted to us as part of your order exclusively for the processing of your order.  We use the external service providers listed below to process the order.

(a) For delivery of the goods, your address data must be disclosed to our parcel service provider. They undertake to handle your data confidentially and to save and use it exclusively for the purpose of delivery and to delete it following successful delivery. The legal basis for the disclosure of data is Art. 6 Para. 1 lit. b GDPR.

(b) Your payment data is disclosed to the bank commissioned and/or to the payment services provider selected in each case for payment processing. The legal basis for the disclosure of data in this case is Art. 6 Para. 1 Clause 1 lit. b GDPR.

Your payment data is transmitted to the relevant payment services provider depending on the means of payment you choose. The payment services provider bears responsibility for your payment data. We disclose your personal data (full name, date of birth, address, email address, bank account details, credit card details, mobile number if applicable, and data on your respective ticket purchases) and all modifications to LogPay Financial Services GmbH for the purpose of sale and the assignment of our receivables from you in connection with your ticket purchase. The legal basis is Art. 6 Para. 1 Clause 1 lit. f GDPR. Our vital interest lies in the outsourcing of payment processing and receivables management. The vital interest of LogPay Financial Services GmbH lies in the collection of data for the purpose of processing payments, receivables management, evaluation of the reliability of payment types, and prevention of payment defaults.

You can object to the disclosure of this data to LogPay Financial Services GmbH at any time. However, this will mean that no orders can be placed via the electronic sales channel.

6. When subscribing to our newsletter

(1) When you order our newsletter, you declare your permission for us to use your email address for our own promotional purposes (known as direct advertising).

Permission to send the newslette

“I would like to receive the monthly passenger newsletter with information on various services and offers from ESWE regularly via email. I can retract this permission for the use of my email address at any time.”

(2) Subscription to our newsletter uses the double opt-in process. This means that, once you register with your email address, you will receive an email containing an activation link, which you must confirm to complete registration. Registration is only complete once you have clicked the activation link. As part of registration, we save your IP address and the times of registration and confirmation alongside your email address. This is done in order to clarify any later misuse of third-party data and to verify your registration.

(3) Where registration is not confirmed within 24 hours using the activation link, we will automatically delete the data saved during registration. 

(4) You email address is all you need to provide in order to subscribe to the newsletter. Providing further, separately marked data is optional and is used to allow us to address you personally. Following your confirmation, we save your email address for the purpose of sending the newsletter, in which we inform you about our products and services. The legal basis for the processing of your personal data is your permission in accordance with Art. 6 Para. 1 Clause 1 lit. a GDPR.

(5) You can retract your permission for the storage and use of your email address for sending the newsletter at any time with effect for the future and unsubscribe to the newsletter by sending an email to: interneteswe-verkehr.de, or clicking the link at the end of each newsletter. We will delete your personal data as soon as you retract your permission, unless it is followed by a contractual relationship during whose period further processing in permissible. The legal basis is Art. 6 Para. 1 Clause 1 lit. b GDPR.

7. When contacting us via email or contact form

(1) When you contact us via email or using the contact form on our website, we collect and save personal data. The contact form shows which personal data is collected when you contact us using the contact form. If you contact us via email, we collect and save the following personal data: email address, email text and further data provided optionally.

(2) We process the data you provide exclusively in order to process your enquiry. The legal basis is Art. 6 Para. 1 Clause 1 lit. b GDPR and/or our vital interest in responding to your concern in accordance with Art. 6 Para. Clause 1 lit. f GDPR.

(3) Where storage is no longer required, we will delete all personal data collected in connection with this. In the context of an enquiry via email or the contact form, we will delete your personal data once contact has been made and the conversation concluded, unless this is followed by a contractual relationship during whose period further processing is permissible. The legal basis in this case is Art. 6 Para. 1 Clause 1 lit. b GDPR. The conversation is concluded when the circumstances indicate that the enquiry has been responded to.

When these common plug-ins are used, personal data is transmitted to the social networks even without interaction with the respective social plug-in. We have therefore implemented the “Shariff” solution for the social plug-ins. 

Shariff allows you to determine if and when data is transmitted to the operators of the respective social networks. This means that no data is transmitted to the social networks when you access our website.

Only when you click one of the buttons is a connection between your browser and the servers of the respective social network created and data transmitted. The plug-in provider receives and saves data (especially the IP address) that enables them to recognise which page of our website the user accessed. Integration of YouTube videos

We have incorporated YouTube videos into our website. These are saved on http://www.YouTube.com and can be played directly from our website. They are provided by “YouTube”, a service that belongs to Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”).

They are all integrated in “enhanced privacy mode”, which means that no data about you, the user, is transmitted to YouTube if you do not play the videos. Only when you play the videos is the data listed in the paragraph below transmitted. We have no influence over this data transmission.

YouTube uses cookies to analyse your user behaviour. When you visit our website, YouTube receives the information that you have accessed the respective sub-page of our website. The data collected by us and listed above under Section 4 “Visiting our website” is also transmitted. This occurs regardless of whether YouTube provides a user account to which you are logged in, or whether there is no user account. Integration of Google reCaptcha

In order to protect input forms on our website, we use the “reCAPTCHA” service from Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA, hereinafter referred to as “Google”. Using this service makes it possible to distinguish whether the entries in our forms have been made by a person or improperly through automated processing by a machine (spambot). As far as we know, the following data is transmitted to Google in this process: the URL (referrer), the IP address, the behaviour of the website users, information about the operating system, browser and length of stay, cookies, display instructions and scripts, the entry behaviour of the user, and cursor movements around the reCAPTCHA checkbox. All this information is used to distinguish better between human and machine entries.
